Frame and
Springs
Clayton Marcus provides a lifetime limited
warranty covering materials against failure or
breakage. The product
must be upholstered in the original fabric and be used in normal
conditions. This
warranty applies only to the original
purchaser.
Cushions
Clayton Marcus provides a seven (7) year
limited warranty on our standard cushion core. This will be prorated as
follows: The first year
is fully covered with the replacement of defective cushion cores at
no charge. After year
one the customer will be responsible for l/6 of the cost
of the cushion core for each year of use up to seven years. The
Feather Down optional core and Fiberfill back cores have a (1) year
warranty and require maintenance by fluffing. This warranty applies to the
original purchaser and is valid only if the furniture has received
normal usage and has not been subjected to abuse or improper
care. Warranty does not
apply to the normal flattening that occurs when using foam products.
Warranty does not cover shipping charges after the first year.
Fabric
Clayton Marcus provides a one (1) year
limited warranty on fabric.
This warranty does not cover picks, fading, normal wear,
wrinkling or pilling.
This warranty applies to the original purchaser and is valid
only if the furniture has received normal usage and has not been
subjected to abuse or improper care. Clayton Marcus does not cover
animal abuse or does not warrant any fabric that has been
after-treated with a chemical.
All warranties above are intended for
residential use only.
The warranty does not cover pieces used in a commercial
setting.

warranties are good to the original purchaser against defective
material or workmanship.
Warranty
Procedures
Clayton Marcus will repair or replace at our
option any part or parts of the warranted product found to be
defective within the terms of the warranty. These repairs will be made
without a charge for materials, labor, shipping or handling between
an authorized Clayton Marcus Dealer and our factory as long as the
dealer sends a notice of the defect within one (1) year from the
date of retail delivery of the furniture. After one (1) year, Clayton
Marcus will cover the cost of labor and materials for any
merchandise that is covered under our warranty agreement. The Dealer will be
responsible for paying a shipping and handling fee for product
returned that is over one (1) year from the date of retail
delivery. Product
scheduled for return to the factory must have appropriate packaging
to minimize freight damage.
* Some Clayton
Marcus Dealers offer warranties on our products more limited than
the one’s stated above.
In that case, the Dealer’s more limited warranties govern and
replace these warranties.
Freight
Damage
Freight damage must be noted on Bill of
Lading at time of receipt.
The freight issue must be handled immediately and no later
than 45 days. Freight
damage is an issue between the store and the freight carrier. Clayton Marcus will not be
the arbitrator should these issues arise.
When Repairs
are Needed
The Dealer and
the Clayton Marcus Sales Representative should determine if the
repair is covered by Clayton Marcus’ Limited
Warranty.
Authorization
for a warranty repair can be obtained by first calling the Clayton
Marcus Sales Representative.
If it’s determined to be a warranty covered repair then the
Sales Representative will issue a full warranty report to the Dealer
Service Department to begin processing the
request.
In some cases,
the factory might need to see a digital photo, an arm cap or cushion
casing illustrating the particular problem before they can determine
whether it falls within the scope of the warranty. A warranty repair my also
necessitate the Clayton Marcus Sales Representative to visit the
store or home where the product is located.
Local
Repairs
It is preferred
to have repairs done locally in your area. When a repair has been
authorized the Clayton Marcus Dealer Service Department will
establish reimbursement allowances prior to the repair being
performed. A local
repair bill must be submitted to Clayton Marcus within 60 days of
the repair date before a reimbursement can be given. The initial acknowledgment
or invoice number and purchase date must be referenced on the repair
bill.
When Ordering Replacement
Parts
- Dealer is
required to provide proof of purchase date and acknowledgment
number for furniture when
replacement parts are needed.
- Fabric parts ordered after one (1) year
will be subject to a charge, if available.
- The original part will need to be sent in
to match pattern placement or to help with dye lot
match.
- Replacement cushion cores are shipped
directly from the cushion vendor
- Fabric mills do not guarantee dye lots to
be exact between fabrics

Warranty
Disclaimer
To obtain service under the warranty, the
consumer will need to report any problems to his furniture retailer.
We require an original
bill of sale from an authorized Clayton Marcus dealer for all
returns and allowances to Clayton Marcus.
These warranties are limited to repair or
replacement of the defective part, or substitution of product, in
Clayton Marcus’s sole discretion. These warranties are in lieu
of all other warranties, expressed or implied, including the implied
warranties of merchantability and fitness for a particular
purpose. Clayton Marcus
will not be liable for any special, incidental, consequential or
indirect damages, even if it has reason to know in advance that they
are possible. These
warranties give you specific legal rights and you may have other
rights that vary from state to state. Some states do not allow the
exclusion of implied warranties or the limitation of damages, so the
above exclusions and limitations may not apply to you. In the event the warranty
exclusions do not apply to you, then where legally permissible, such
implied warranties are limited in duration to the stated warranty
period and no warranties apply after that period. In circumstances in which
the warranties provided herein do not apply, the products involved
are, where legally permissible, still subject to the above
disclaimer of implied warranties and the above limitation of
damages. Clayton Marcus
does not authorize anyone, including its dealers, to create for it
any other warranty, obligations or liability in connection with its
products.
